Data Protection

General Information

Users acknowledge that the Operator processes the personal data provided by them for the purpose of operating the Platform in compliance with legal provisions governing the processing and protection of personal data. This includes, but is not limited to, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and the free movement of such data (General Data Protection Regulation, "GDPR"), and Act No. 110/2019 Coll. on the processing of personal data, as amended. Details regarding the processing of Users' personal data by the Operator are set out on the Platform.

Definition of Personal Data

Personal data refers to any information about an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, through details such as a name, identification number, location data, network identifier, or other characteristics related to physical, physiological, genetic, mental, economic, cultural, or social identity.

Data Processed by the Operator

The Operator processes the following personal data provided by Users:

  • First and last name
  • Email address
  • Telephone number
  • Other identification and address data

This data is processed only to the extent provided by the User.

Lawfulness of Processing

The processing of personal data is considered lawful when at least one of the following conditions is met:

  1. The User has provided consent to the processing of their personal data.
  2. The processing is necessary to comply with a legal obligation applicable to the Operator.
  3. The processing is necessary for the legitimate interests of the Operator.

Purposes of Data Processing

The Operator processes personal data for the following purposes:

  1. Providing services and fulfilling contractual obligations. Processing in this context is essential for the performance of the contract.
  2. Protecting the Operator's rights and asserting possible claims, which is considered a legitimate interest.

Data Retention

The Operator stores personal data only for as long as it is necessary to fulfill the rights and obligations arising from the contractual relationship. After the expiration of this period or upon withdrawal of consent, the personal data is deleted. Personal data may also be retained to protect the Operator's rights as long as its legitimate interest persists.

Transfer of Personal Data

Personal data provided by the User may be transferred to third-party processors who provide consulting, marketing, and other services to the Operator. Any transfer is made in accordance with the stated purposes of processing.

User Rights

Under the GDPR, Users have the following rights:

  1. Access their personal data.
  2. Request the rectification or restriction of the processing of their personal data.
  3. Request the erasure of personal data.
  4. Object to the processing of their personal data.
  5. Exercise the portability of their personal data.
  6. Withdraw consent for data processing.

To exercise these rights, Users may contact the Operator via email at info@flowlance.com. The Operator will assist Users in exercising their rights.

Security Measures

The Operator has implemented appropriate technical and organizational measures to secure the personal data provided by Users. Only individuals authorized by the Operator have access to this data.

Disclosure

The use and transfer of information received from Google APIs to any other application will adhere to the Google API Services User Data Policy, including its Limited Use requirements. For more details, visit Google's User Data Policy.

Effective Date

These terms and conditions are effective as of 22 March 2023.
